PICTURES SUPPLIED BY DIRECT DOWNLOAD

By downloading a digital consignment of our pictures, you implicitly agree to the following conditions  in their entirety. If this is not acceptable, do not proceed with the download.

Retention of scanned pictures: MEPL accepts that the client may store downloaded high resolution  images of pictures transmitted digitally for the duration of the project for which the pictures have  been purchased. This does not entitle the client to any usage or reproduction rights beyond those  explicitly agreed by MEPL. MEPL pictures are watermarked and unauthorised use can be detected  electronically.

Application to use service: Once we have approved your application to use this service, and you have been granted access to it,   you will be responsible for providing usage information and supplying payment for any pictures downloaded under you user account. We reserve the right to deny access to this service to any person or company without explanation.

Assumption of use: This service is intended for the download of high resolution scans for use. Occe you download a picture, we assume  you are going to use it. The onus is on you to advise and explain why any downloaded picture has not been used.  If such advice is not provided, you will be billed at our standard rate, or according to any rates agreement which exists between us.

Access to the service: MEPL resreves the right to withdraw the Direct Download facility from any client  at any time without giving notice. Clients who repeatedly fail to provide timely usage information will be declined  access to this service.

Passing on pictures: Scanned pictures may not be passed from one client to another, even  within the same organisation, except by prior explicit agreement with MEPL.

Right to use: The receipt of digital images from MEPL confers the right to use the pictures  only as explicity agreed by MEPL.

Rates: It is the client's responsibility to be aware of our current rates, which are updated  on 1st January each year. At this time all previous rates are invalid unless they are the subject  of a specific agreement with MEPL.

Guide Prices: The guide prices displayed prior to download are for information only. They reflect  standard prices for the usage specified by you. They will not necessarily be used for invoicing. If we are unable  to ascertain actual usage for pictures from you, then we will invoce at a rate of our chosing which will not be constrained  by any guide prices displayed prior to download.

Fee Agreements: If you have a fee agreement with us, this will be applied in the invoicing of any images  downloaded from this site which, the use for which falls within the terms of your agreement with us. By selecting to "Apply Fee  Agreement" prior to downloading, we are not extending the scope or particulars of your fee agreement for any images downloaded for  use which falls outside the scope of your fee agreement.

Download Problems: If you encounter any problems downloading files you should notify as soon as possible. We will  not charge you for any images which you do not successfully download.

Credits: Any picture reproduced, advertising excepted, must be credited to MARY EVANS PICTURE  LIBRARY (together with contributor co-credits, when indicated).

Voucher copies: A complimentary copy of any published work in which a MEPL picture is used  should be sent to us on publication, or details (website address) of where pictures have been used  digitally.


PICTURES SUPPLIED ON TRANSPARENCY

By accepting delivery of our pictures, you implicitly agree to the following conditions in their entirety. If this is not acceptable, you must phone us immediately to discuss the matter or return our pictures, unused, at once. Unless pictures are sent back by return, it is understood that you are willing to pay at current MEPL rates for the use of pictures; a Service Fee if no use is made; and a Holding Fee if pictures are held beyond the agreed period.

Return of pictures: Any picture supplied by MEPL is on loan and must be returned as soon as it is no longer required. All pictures must be returned by the due date on the delivery note. After that date, unless an extension has been granted, you are liable for a holding fee. This fee will be charged per picture, per week at the current rate. If overdue pictures are not returned within a reasonable period, MEPL reserves the right to invoice for loss.

Rates: It is your responsibility to be aware of our current rates, which are updated on 1st January each year.These new rates automatically invalidate all previous rates information.

Payment in advance: In some cases, MEPL may request payment, or part payment, in advance.

Responsibility for pictures: If sent by post, pictures supplied by MEPL are our responsibility until they reach you. Pictures collected by courier, or by your representative, are your responsibility as soon as they leave MEPL. You are henceforth responsible for their safe keeping, for their return in good condition, for informing us of their use and for arranging payment. This responsibility ends when both pictures and payment have been received by MEPL.

Damage and loss: If you receive pictures in a damaged condition, or there is any discrepancy between the number of pictures received and the number registered on the delivery note, you must inform MEPL immediately. Unless you do so within 3 days, we must assume pictures have been lost or damaged while in your possession and will invoice accordingly. You should inform MEPL of any misuse or damage to pictures whilst in your possession.

Right to use: The borrowing or purchase of a picture from MEPL does not confer the right to use it. This right is conferred only on full payment of our invoice. MEPL current rates apply unless there is written agreement to the contrary. If you wish to negotiate a special rate for the right to use a picture, you should do so in advance.

Informing MEPL of use: It is your responsibility to inform MEPL when and how a picture is to be used. When doing so, it is essential to provide us with the identifying number of each picture. Payment need not be made until the time of use but is then due immediately. Invoices for reproduction in books are sent one calendar month before publication, unless otherwise requested. Any additional use (including electronic rights) must be cleared prior to publication. Terms are net monthly. Payment for purchase of prints, service and search fees, and charges for loss and damage must be paid immediately the invoice is received.

Copying and storing pictures: Pictures supplied by MEPL may not be copied or stored by electronic or other means except for the purpose for which they were originally supplied.

Voucher copies: A complimentary copy of any work in which a MEPL picture is used should be sent to us on publication.


PICTURES SUPPLIED AS HIGH RESOLUTION SCANS ON CD-ROM

By ordering and opening a CD-ROM package of high resolution images you implicitly agree to the following conditions in their entirety. If this is not acceptable, do not open the package and return it to MEPL with the seal intact.

Retention of scanned pictures: MEPL accepts that the client may store copies of high resolution images provided on CD-ROM for the duration of the project for which the pictures have been purchased. This does not entitle the client to any usage or reproduction rights beyond those explicityly agreed by MEPL. MEPL pictures are watermarked and unauthorised use can be detected electronically.

Passing on pictures: Scanned pictures may not be passed from one client to another, even within the same organisation, except by prior explicit agreement with MEPL.

PICTURES VIEWED VIA ONLINE SEARCHES.

By conducting an online search, you implicitly agree to the following conditions in their entirety. If this is not acceptable, do not proceed with your on-line search.

Retention of scanned pictures: MEPL accepts that the client may store off-line (on one computer only) copies of low resolution images sourced via an on-line search conducted on the MEPL website. These pictures may be stored for selection purposes only. This does not entitle the client to any usage or reproduction rights. Clients may keep off-line copies of low resolution images for up to three months after which time they must be deleted. MEPL pictures are watermarked and unauthorised use can be detected electronically.

Passing on pictures: Scanned pictures may not be passed from one client to another, even within the same organisation, except by prior explicit agreement with MEPL.

Right to use: The acquisition of any image as a result of an on-line search on the MEPL website, confers no right to use it. This right is conferred only when an order is placed and fee agreed with MEPL for high resolution images which are supplied on-line, via CD-ROM or on photographic transparency, in which case the relevant Terms and Conditions for picture supply apply.

Rates: Although no charge is made for access to low resolution images sourced via an on-line search conducted on the MEPL website, it is the client's responsibility to be aware of our current rates of picture use, which are updated on 1st January each year. At this time all previous rates are invalid unless they are the subject of a specific agreement with MEPL.
