Civil War Union Maj. Gen. Benjamin Butler
Civil War Union Maj. Gen. Benjamin Butler was in command of Fort Monroe on the James River in Virginia. In May 1861 Butler refused to return fugitive slaves sheltering in Fort Monroe to Confederate Colonel, Charles Mallory. First Butler argued the Federal Fugitive Slave Law of 1850 did not apply because Virginia seceded from US. Secondly, Mallory was using the men to build fortifications, making their confiscation as contraband property legal according to the rules of war. Photo by J. Gurney, and Son
